Kept in the dark again

Michael Laws, Mayor, Wanganui
Exhibit A: Vision Wanganui's Democracy Policy.

"...democracy is based upon empowering informed citizens..." (Unless it's about trees).

"Communication between Council and citizens is poor. Too little accessible information is made available to Wanganui people" (unless it's about trees, in which case it's perfectly okay).

"There are serious doubts at the effectiveness and frequency of current communications from the Council to its citizens" (and we intend to keep things that way).

Exhibit B: Local Government Act 2002.

14 (1) (a) a local authority should—
(i) conduct its business in an open, transparent, and democratically accountable manner.

78 (1) A local authority must, in the course of its decision-making process in relation to a matter, give consideration to the views and preferences of persons likely to be affected by, or to have an interest in, the matter.

82 (1)(a) persons who will or may be affected by, or have an interest in, the decision or matter should be provided by the local authority with reasonable access to relevant information in a manner and format that is appropriate to the preferences and needs of those persons.

82 (1)(b) persons who will or may be affected by, or have an interest in, the decision or matter should be encouraged by the local authority to present their views to the local authority.

82 (1)(e) the views presented to the local authority should be received by the local authority with an open mind and should be given by the local authority, in making a decision, due consideration:

48 Right of local authorities to exclude public:

(1) Subject to subsection (3) of this section, a local authority may by resolution exclude the public from the whole or any part of the proceedings of any meeting only on one or more of the following grounds:

(b) That the public conduct of the whole or the relevant part of the proceedings of the meeting would be likely to result in the disclosure of information the public disclosure of which would —

(i) Be contrary to the provisions of a specified enactment (nope) ; or
(ii) Constitute contempt of Court or of the House of Representatives (nope);


(c) That the purpose of the whole or the relevant part of the proceedings of the meeting is to consider a recommendation made to that local authority by an Ombudsman... (nope)


(d) That the exclusion of the public from the whole or the relevant part of the proceedings of the meeting is necessary to enable the local authority to deliberate in private on its decision or recommendation in any proceedings to which this paragraph applies (see below).

(2) Paragraph (d) of subsection (1) of this section applies to—

(a) Any proceedings before a local authority where —
(i) A right of appeal lies to any Court or tribunal against the final decision of the local authority in those proceedings (nope); or
(ii) The local authority is required, by any enactment, to make a recommendation in respect of the matter that is the subject of those proceedings (nope); and

(b) Repealed.

(c) Any proceedings of a local authority in relation to any application or objection under the Marine Farming Act 1971 (nope).


Summing Up

So we put it to you, members of the Wanganui public, that you've been kept in the dark on matters which were rightly your business, and for no reason that's possibly justifiable under law. Dotty has of course pleaded insanity, and about that there can be no doubt. But that still leaves recidivist recreant Mickey and Frau Himmler Higgie. Both with lengthy records and, if allowed to get away with this albeit seemingly minor offence, likely to reoffend in even more diabolical ways. How say you?


Update (2.00 pm 8 December): Around this time last year we posted a picture of Mickey as Bad Santa. Little did we know that we'd uncovered a scoop: Mickey has, in fact, taken on a holiday job at Harrods.

Bogan comment coup

In an early demonstration of power and influence, Bogan strikes! Yes, Dotty's Drivel is back on the front page. This time, she messes herself with an admission that she enjoys reading annual reports. "Must I be a total nerd?" She asks. Er, sorry to break it to you Dotty, but nerds are usually represented as clever.

And clever the Deputy Mayor certainly isn't. Having made a very public point that we would soon be finished paying for storm-water separation, she now admits that it's causing an increase in borrowing. No mention of diVision's little spend up down on the river or up at the Splash centre, but here your correspondent is inclined to be charitable: it's an awful lot to have to keep track of for poor Dotty.

First blood to Bogan.

We all need a Christmas break from Mad Mickey, anon. Clearly, having to listen to and repeat his lame excuses here day in, day out (because, as we all know, he never comes here himself), is having a deleterious effect on your brain.

The topic of the post isn't "who saved the trees". We never mention who did, or didn't, save the trees, or wanted to cut them down.

Because quite frankly, it'd be pointless, given that diVision press releases and Letters to the Editor could now be colleted into a book called "Lies and the Lying Liars Who Tell Them" if it hadn't already been written by Al Franken.

Read the post again. Try saying the words aloud. If all else fails, ask a friendly Watcher to explain it to you.

Stop Press

Finally the wait is over! You've been waiting with baited breath to hear the results of the fierce competition for naming rights at the new Sewage plant, and here they are, folks.

First up we will have the Michael Laws Memorial Sludge Pond, a steaming vat of faecal matter, used condoms, tampons and anything else that goes down the pipe.

Next, and subject to lots of late bids, the Warburton Filters. All the raw effluent from the Michael Laws Pond goes through here.

The next item, we hope, won't see much use, as it relates to emergency outflows, and is called the Vision Wanganui Overflow Pipe.

And finally, the sedimentary pool. In one stroke, Mayor Laws has created two efficiencies out of one: this will be named The Splash Centre.

Not an answer Laws Watch - the business of the trees wasn't on ANY council agenda including notification of confidential items.
That must mean that there was no discussion and no resolution and that is what Cr Higgie said in her letter to the Chronicle. That Stevens and Dahya did it all by themselves.
So ... Dim One ... where is the proof that ANY attempt was made by the mayor or his Vision cohort to hide council business??

PS Can you answer the Q from that other poster - when are you going to break anything new?

You're right in this much, anon: We acknowledge that no councillor involved in this unseemly little bit of skulduggery has acquitted themselves well, and it's not just the diVisionites.

According to a letter writer to the Chron, Cr Stevens tried to blame "the council arborist", who turns out to have been a figment of his imagination.

Cr Dahya said Cr Higgie had decided which trees should get the chop, as if that excused his complicity in permitting it to be discussed behind closed doors.

And Cr Higgie said... well, we're never sure what she's trying to say, other than "nothing's my fault" and, perhaps, "some of my best friends are trees".

Our post does make it sound as though only the diVisionites were responsible, when in fact our "independent" councillors once again let Wanganui down.

In light of the fact you think ML and Vision councilors can't be trusted; and,
In light of the fact you think non-Vision councilors or independents can't be trusted;
What's the solution?
when ML challenged his critics to put up candidates earlier this year in the by-elections, some did and they lost and uncomfortably so.

anon @ 9.26 that's an excellent question requiring a lengthy answer. We'd planned to blog on it over the Christmas break but the short version is:

People who stand as "anti Laws" candidates aren't going to be embraced by the electorate. And indeed if that's their primary reason for standing they're not what Wanganui needs and deserve to lose.

Voters have had enough of a Mayor who's "anti" so many things, and so many people. They don't want divisive, bitter leadership from people focused on him - they want unifying visionary leadership from people focused on Wanganui.

The people who'll win, and deservedly so, are those who can articulate a positive vision while withstanding diVision's dirty politics (yes, Bog, we're looking at you) without descending to their level. And - unfortunately - they're going to need to be able to match (or have backers who match) the vast amounts of money Mickey is prepared to spend to get himself and his acolytes into positions of power.

Who are they? We wish we knew.

Rather a lot of assumptions there, 9:31. For a start, you assume there will be 12 councillors next time. Then, you assume the Visionaries who haven’t had the good sense to run for the hills will romp back in, having had three years to prove to one and all what duds they are. (Well, 18 month for BH, but she isn’t hard to read.) You also assume suitable replacement puppets can be found to fill enough seats to have a majority...remember, we could have 14 councillors next time.

The poll should have asked what people think of party politics as the concept applies to local government. I think even the determinedly un-involved are beginning to wake up and there is still quite a bit of time for the disadvantages of one person calling the shots to show up. You think people haven’t noticed the waste of 250K in rates money in pursuit of one man’s (and his librarian’s) fantasy?

Mickey's spin fairies aren't exactly known for their longegevity but this must be some sort of record but the latest incarnation seems to have gone from zero to hero to zero by lunchtime.

It was interesting that Mickey didn't say peep about Paul Brooks appearing at his side but then the MidWeek front page had him lining up with Sally, Nicki et al at the beach and called him COMMUNICATIONS MANAGER.

A day later River City Press has demoted him to PRESS SECRETARY.

So what's going on, Mickey, and how much of his salary are you paying?

So Mickey thinks that management of the port should be given to a council couldn’t manage a pissup in a brewery, let alone keep itself reasonably staffed, or look after a bunch of trees or a rebranding exercise or an architectural project like the Heart. No thanks, Wanganui would be better off with someone like Tuffy Churton than the bunch of incompetent f—kups at Guyton St and Winc. Speaking of which, it’s interesting to see Mickey threatening to take get out his shotgun … (“If I could find the people responsible, I would shoot them,” he said.) Now that might at least save some legal bills.

Are you people joking about the port because its been - to quote a local architect - a dog for years and fleeced by the old money here until the wharves rotted and sand silted the river channel.

Ask Q-West and they'd back the council 100% in tracking down our local Fay Richwhites and asking where the money has gone. The Port is Wanganui's NZ Rail.

Tuffy Churton must be smiling because that was what he was saying 2 years ago. The only problem was that Tuffy was offering himself as the solution.

It is good to see the mayor and council providing real leadership over the dreadful situation at the port.

Mr Laws has been a "new broom" and despite the occasional prat fall he has made council more responsive and open. If people are complaining now then they should have seen the last one and the ones before that.

This legal action would never have occurred under Chas. The place would have fallen over before the council would have got interested.

Wanganui District Council staff today apologised to the people of Wanganui for two years' worth of inaccurate information provided to the public on just about every topic that Mayor Laws has instructed them to lie about. A staff spokesbody said the list was too long to fit in a single newspaper but included blaming and shaming just about everybody who had ever done anything for Wanganui and every word written in support of mad mayoral ideas in referenda, agendas, press releases, annual plans, long-term plans ... etc.
